b) Mobilizing employees to work overtime without their consent, except as provided for in Article 108 of the Labor Code.
Thus, employers who force their employees to work on holidays may face a maximum fine of 25,000,000 VND. If the business proposes working on a holiday and the employee agrees, it is not considered a violation. In this case, besides the holiday wage, the business must also pay overtime wages of at least 300% of the regular wage for daytime work and at least 390% for nighttime work (according to Article 98 of the 2019 Labor Code).
