According to Clause 1, Article 27 of the 2006 Residence Law, the following cases with the same legal residence are eligible for separate household registration:

Individuals with full civil act capacity who wish to be removed from the household registration
Individuals who have been added to the household registration as specified in Clause 3, Article 25 and Clause 2, Article 26 of this Law, and have the consent of the head of the household in writing.
Those who share the same legal residence and have a family relationship as grandparents, parents, spouses, children, siblings, uncles, aunts, or grandchildren can be registered in the same household.
Individuals who meet the conditions for permanent residence in provinces or centrally-run cities as specified in Articles 19 and 20 of the 2006 Residence Law.
Those who have the consent of the head of the household to be added to the individual/family’s household registration.

According to the Residence Law effective from July 1, 2021, the following cases are eligible for separate household registration:

Individuals with full civil act capacity; in cases where multiple members register to form a new household, at least one of them must have full civil act capacity.
Those who have the consent of the head of the household and the owner of the legal residencei>, except in cases where the separating household members are divorced spouses who still share the same legal residence.
The permanent residence of the household does not fall under the cases specified in Article 23 of this Law.

3Procedure for Removal from Household Registration when Moving to a New House

According to the latest information as of July 1, 2021, the procedure for removal from household registration when moving to a new house is governed by the 2020 Residence Law. This procedure is referred to as permanent residence registration at a new place of residence.

The steps for removal from household registration when moving to a new house are as follows:

According to Article 22 of the 2020 Residence Law, individuals registering for permanent residence must submit their documents to the local police station in their area of residence.

Upon receiving the documents, the residence registration authority will inspect them and provide a receipt to the registrant. If the submitted documents are incomplete, the receiving authority will guide the registrant to supplement the necessary documents.

Step 3 Process the permanent residence registration

Within 07 working days from the date of receiving complete and valid documents, the residence registration authority is responsible for evaluating the documents, updating the information about the new place of residence of the registrant in the Residence Database, and notifying the registrant about the update of their permanent residence information. In case of rejection, a written response must be provided, stating the reason.

When registering for permanent residence at a new house, the previous permanent residence registration will be canceled (according to Article 24 on cases of cancellation of permanent residence registration).
