When is it mandatory to switch to the new land certificate with a QR code?

According to Clause 1, Article 38 of Decree 101/2024/ND-CP, the following cases require the replacement of previously issued land certificates:

(1) The issued certificate is stained, blurred, torn, or damaged;

(2) The certificate was issued jointly for multiple land plots, and separate certificates are now required for each plot according to the land user’s needs. This also includes the case of replacing the Certificate of Land Use Rights and Ownership of Assets Attached to Land as prescribed in Clause 7, Article 46 of Decree 101/2024/ND-CP;

(3) The purpose of land use stated on the issued certificate, in accordance with land law provisions at the time of issuance, differs from the purpose of land use as classified under Article 9 of the 2024 Land Law and detailed in the Government’s Decree guiding the implementation of several articles of the 2024 Land Law;

(4) The location of the land plot on the issued certificate is inaccurate compared to its actual location at the time of certificate issuance;

(5) The land use rights and ownership of assets attached to the land are jointly owned by the husband and wife, and the issued certificate only bears the name of either the husband or the wife. Now, there is a request to replace the certificate to include both the husband’s and wife’s names;

(6) The issued certificate bears the name of a household, and the household members with shared land use rights request a replacement certificate to include the names of all members with shared land use rights within the household;

(7) The address of the land plot on the issued certificate has changed;

(8) The dimensions of the sides, area, or plot number of the land have changed due to land surveying and mapping or land parcel mapping, while the plot boundaries remain unchanged.

Additionally, if land users wish to replace certificates issued before August 1, 2024, with the new Certificate of Land Use Rights and Ownership of Assets Attached to Land, they can do so according to regulations.

New Name for the Red Book/Pink Book in 2025

From August 1, 2024, with the enforcement of the 2024 Land Law, the Red Book and Pink Book have been given a new legal name: “Certificate of Land Use Rights and Ownership of Assets Attached to Land,” according to Article 43, Clause 2, Point a, of Circular No. 10/2024/TT-BTNMT. The old certificate template will remain valid until December 31, 2024. The new certificate template with its legal name will officially come into effect on January 1, 2025.
