The process of switching to the new chip-based ID card (CCCD) has been underway since the official announcement. However, some citizens who have a registered household in their hometown but are working in another locality may still have questions about whether they can obtain the new CCCD at their temporary residence. Regarding this matter, the following clarification is provided based on the Law on Citizen Identification:
According to Article 26 of the Law on Citizen Identification 2014 and Article 16 of Circular No. 07/2016/TT-BCA, before the National Database on Population and the Citizen Identification Database are fully operational, the following principles apply to the issuance of CCCD:
In cases of card replacement as specified in Points a and b, Clause 1, Article 23 of the Law on Citizen Identification, and re-issuance of cards for citizens with permanent residence in another province or city under the central government’s jurisdiction, the following regulation applies: “The provincial-level Public Security authority in charge of CCCD management shall receive applications for issuance, replacement, and re-issuance of CCCD cards for citizens with permanent residence within the respective province or city”
1 Can residents with temporary residence in Ho Chi Minh City obtain the new chip-based Citizen Identification Card in the city?
Registration and issuance of chip-based Citizen Identification Cards for both permanent and temporary residents
According to the Ho Chi Minh City Public Security, they will accept registration and issue chip-based Citizen Identification Cards for all permanent and temporary residents in the city.
However, the Ho Chi Minh City Public Security also noted that, until July 1, 2021, they will prioritize issuing the new cards to permanent residents of the city in the following cases:
- Priority will be given to citizens aged 14 and above who have not been issued a Citizen Identification Card.
- Individuals with expired 9-digit or 12-digit ID cards, lost cards, or changes in personal information will also be prioritized.
After completing the issuance for permanent residents, temporary residents will be served.
To obtain the new chip-based Citizen Identification Card sooner, the Ho Chi Minh City Public Security encourages temporary residents to return to their hometowns to register.
During this period, for those who wish to replace their valid 12-digit ID cards or Citizen Identification Cards with barcodes, the Ho Chi Minh City Public Security will not accept such applications.
Therefore, until July 1, 2021, temporary residents in Ho Chi Minh City must return to their place of permanent residence to obtain the new CCCD with a chip.
2 Where should temporary residents in Ho Chi Minh City go to obtain the new CCCD?
Procedures for switching to the new chip-based Citizen Identification Card
The transition to the National Database on Population and the collection of citizen information are relatively new processes, and the database is not yet fully comprehensive. Therefore, the procedures for obtaining the CCCD card are as follows:
- For citizens who already have a CCCD with a barcode or a 12-digit ID card, their information has been updated in the National Database on Population. Therefore, they can apply for replacement or re-issuance of the CCCD at the Department of Social Order Administration (PC06) of the provincial-level Public Security in any province or city.
- For this process, the required documents include: Household registration book, temporary residence book; Old ID card/Citizen Identification Card (if available).
- For citizens with a 9-digit ID card or those who have never been issued an ID card/CCCD, it is mandatory to return to their place of permanent residence to obtain the new CCCD with a chip.
Once the National Database on Population and the Citizen Identification Database are fully operational, citizens will be able to apply for a Citizen Identification Card at any Citizen Identification management agency.
In summary, if you have a 9-digit ID card or have never been issued an ID card/CCCD, you must return to your place of permanent residence to obtain the new CCCD with a chip.
3 How can citizens without a defined place of residence obtain a Citizen Identification Card?
Vietnamese citizens have the obligation to register their place of residence, whether permanent or temporary, with the competent public security authority. This ensures the exercise of civil rights and facilitates the processing of administrative procedures related to the citizen in question, in accordance with the law.
The Law on Citizen Identification 2014 stipulates that Vietnamese citizens aged 14 and above, residing in Vietnam, are required to go to the public security authority where their household registration is located to apply for an ID card/Citizen Identification Card. They must present their household registration book (indicating their place of permanent residence) when applying.
Temporary Residence Registration
According to the Law on Residence 2006 (currently in force), “Clause 1, Article 12. Place of Residence of Citizens”:
- The place of residence of a citizen is the lawful place of residence where the person regularly lives. The place of residence can be either the permanent or temporary residence.
- Permanent residence is where a citizen regularly and permanently lives without any time limit at a specific address and has registered for permanent residence. Temporary residence is where a citizen lives outside their registered permanent residence and has registered for temporary residence.
- In cases where the permanent and temporary residence of a citizen cannot be determined according to the above regulations, the place of residence shall be where the person is currently living.
Therefore, individuals who have not registered for permanent or temporary residence in any locality should immediately go to the public security authority of the ward or commune where they are currently living to declare their place of residence and receive guidance on the procedure for applying for a Citizen Identification Card.
From July 1, 2021, according to Circular No. 59/2021/TT-BCA, which provides guidance on the Law on Citizen Identification and its implementing decrees, citizens are allowed to obtain the CCCD with a chip at their place of temporary residence. Specifically:
- Citizens can directly go to the competent Public Security authority for receiving applications for issuance, replacement, or re-issuance of Citizen Identification Cards, either at their place of permanent or temporary residence, to submit their application.
- If citizens choose to apply for issuance, replacement, or re-issuance of the Citizen Identification Card through the National Public Service Portal or the Ministry of Public Security’s Public Service Portal, they can select the service, check their information in the National Database on Population, and if the information is correct, they can schedule an appointment for submitting their application at the chosen Public Security authority. The system will automatically forward the citizen’s request to the selected authority.
- In case a citizen checks their information in the National Database on Population and finds that their information is missing or incorrect, they should bring valid documents to prove their information when going to the Public Security authority to submit their application for issuance, replacement, or re-issuance of the Citizen Identification Card.
