According to Article 9 of Decree 167/NĐ-CP, which stipulates administrative sanctions in the fields of social order and safety, social evils prevention, fire prevention and fighting, and domestic violence prevention:

A warning or a fine from 100,000 VND to 200,000 VND shall be imposed for one of the following acts:

  • Failure to present one’s identification card when requested to do so by an authorized person.
  • Non-compliance with regulations on the issuance of new, replacement, or amended identification cards.
  • Non-compliance with regulations on the retrieval and temporary retention of identification cards upon request by an authorized person.

Article 5 of Decree 05/1999/NĐ-CP specifies the following cases where citizens must apply for a new chip-based identity card:

  • Expiration of the current identification card
  • Damage to the identification card, rendering it unusable
  • Changes in surname, given name, middle name, date of birth, or place of residence (outside the province or centrally-run city)
  • Alterations in physical appearance or distinctive features
  • Loss of the identification card, in which case a replacement must be requested.

Thus, citizens who fall under these six categories and fail to obtain a new chip-based identity card will be subject to a warning or a fine of up to 200,000 VND.
