The Ministry of Home Affairs is seeking feedback on the draft circular issuing the Examination and Competition Regulations for the recruitment and selection of civil servants and public employees, as well as the Organization Regulations for conducting examinations and competitions for the recruitment, selection, and promotion of public servants and the consideration of promotions for public employees.

Preparing for the Promotion Examination

According to Clause 1, Article 32 of Decree No. 115/2020/NĐ-CP, which was amended by Clause 16, Article 1 of Decree No. 85/2023/NĐ-CP, and the specific regulations of the Ministry of Management of Professional Cadres of Civil Servants in specialized fields, the Chairman of the Council shall decide on the methods of organization, time, and guidelines for evaluating the application dossiers. This process must ensure accuracy, fairness, objectivity, and scientific rigor.

If necessary, the Chairman of the Council may decide on specific methods and criteria for scoring the application dossiers as a supplementary evaluation method to have additional grounds for determining the successful candidates in the promotion examination.

Organizing the Evaluation of Application Dossiers

Members of the Application Evaluation Panel who are assigned to evaluate the same application dossier shall jointly conduct the evaluation of that dossier;

The members of the Application Evaluation Panel shall examine the application dossiers, arranging the components of the dossiers according to the order of the professional standards, conditions for promotion examination of civil servants, and the evaluation criteria specified in the Application Evaluation Form prepared by the Council;

Based on the components of the application dossier and the evaluation criteria, the members of the Application Evaluation Panel shall assess whether the dossier meets the professional standards and conditions for the promotion examination of civil servants. They shall record the evaluation results and related information (if any) in the Application Evaluation Form. Only original, certified, or legally notarized copies of the dossier components shall be considered valid.

In cases where the application dossier does not fully demonstrate the professional standards, conditions for the promotion examination of civil servants, evaluation criteria, or evidence for determining preferences in the examination, the members of the Application Evaluation Panel shall report to the Head of the Evaluation Panel for synthesis and submission to the Chairman of the Council for consideration and decision on requesting the agency or unit that nominated the civil servant to supplement the application dossier. The deadline for supplementation shall not exceed 05 working days from the date of the Council’s request for supplementation; no supplementation of application dossier components shall be accepted after the specified deadline, even if sent by postal means;

During the evaluation process, if the members of the Application Evaluation Panel do not agree on the evaluation results, they shall transfer the application dossier and their individual evaluation results to the Head of the Evaluation Panel for consideration and decision, or report to the Head of the Evaluation Panel for synthesis and submission to the Chairman of the Council for consideration and decision;

The evaluation results of each application dossier shall be consolidated into a general summary table of evaluation results, bearing the signatures of the members involved in the evaluation and the Head of the Application Evaluation Panel;

The Head of the Application Evaluation Panel shall hand over the evaluation results of each application dossier and the general summary table of evaluation results, sealed in envelopes, to the Council Member cum Secretary;

During the handover and receipt (including the supplementation of application dossier components, if any), a handover minutes must be prepared, bearing the signatures of the transferring and receiving parties, as well as the representatives of the Council and the Supervisory Board.

Deciding on the Promotion Examination Results

The Chairman of the Council shall organize a meeting of the Council to consider the promotion examination results. The Council members shall openly and democratically discuss and agree on the results of the promotion examination and the list of successful candidates.

The Chairman of the Council shall report to the head of the agency or unit organizing the promotion examination of professional titles of civil servants for consideration and approval of the promotion examination results and the list of successful candidates, in accordance with regulations.

The determination of successful candidates in the promotion examination shall be carried out in accordance with Article 40 of Decree No. 115/2020/NĐ-CP, which was amended by Clause 20, Article 1 of Decree No. 85/2023/NĐ-CP, and the regulations of the Ministry of Management of Professional Cadres of Civil Servants in specialized fields.
