What is a traffic fine?

A traffic fine is a form of punishment for traffic safety violations detected through surveillance cameras or technical devices of the relevant authorities. In addition to data from surveillance cameras installed on roads, the fine mechanism also applies to violation data provided by citizens to the Traffic Police (Article 24 of Circular No. 65/2020/TT-BCA). Furthermore, images and videos reflecting traffic violations by individuals and organizations posted on social media, mass media will also be used as evidence to process traffic fines.

If the violator resides in the area where the Traffic Police unit detects the violation, the unit will issue a notification instructing the violator to come to the Traffic Police headquarters to handle the violation. In cases where the violator does not reside in the area where the Traffic Police unit detects the violation, the violation results will be transferred to the Traffic Police unit where the violator resides for handling, processing the violation.

When handling traffic violations, if it is confirmed that the person has violated the law, the Traffic Police will make a record and issue a traffic violation fine. According to Article 10 of Decree No. 118/2021/NĐ-CP, the violator can pay the traffic fine in one of the following forms:

  • Pay in cash directly at the Treasury or commercial banks where the Treasury has opened an account.
  • Transfer money to the account of the Treasury specified in the penalty decision through the national civil service portal.
  • Pay the fine through electronic payment services of banks or intermediary payment service providers.
  • Pay the fine by post.

What happens if you don’t pay traffic fines?

Based on Article 1 Section 73 of the Law on Handling of Administrative Violations 2012, individuals and organizations that violate traffic regulations must comply with the fine within 10 days from the date of receiving the decision. In cases where the administrative violation decision specifies a longer deadline, that deadline will be followed.

If the payment is overdue for more than 10 days from the date of receiving the penalty decision, individuals and organizations will be forced to execute the penalty decision, and for each day of late payment, an additional 0.05% of the total outstanding fine amount must be paid.

In particular, if a car violates traffic regulations and fails to pay the fine within the specified deadline, the registration may be denied because the Traffic Police has sent a notice to the Vehicle Registration Agency to accompany a warning regarding vehicles related to traffic violations. These cases will still be accepted by the registration centers for vehicle inspection. However, the Certificate of Inspection, safety and environmental protection sticker issued will only be valid for 15 days.
