Employees can participate in social insurance through their place of work or voluntarily when the need arises. When you reach retirement age, you can receive pension benefits. So, what is the procedure for receiving these pension benefits, and what documents are required?

1. Pension Benefit Application Process

For employees participating in compulsory social insurance at their workplace

The application process for pension benefits for those participating in compulsory social insurance at their workplace is as follows:

Original Social Insurance Booklet.

Original Decision on Retirement with Pension Benefits according to the model issued together with Decree 46/2010/ND-CP dated April 27, 2010, of the Government or Decision on Retirement with Pension Benefits according to form No. 12-HSB or document on termination of the labor contract with pension benefits.

– Original Minutes of Assessment of Reduced Work Capacity (RWC) by the Council for Assessment of Work Capacity Impairment (in case the employee already has minutes of assessment to enjoy other policies and meets the conditions, a certified copy can be used) for those who retire due to reduced work capacity.

Employees participating in compulsory social insurance at their workplace must prepare their Social Insurance Booklet in the application file

– Certified copy of the Certificate of HIV/AIDS Infection due to occupational risk (equivalent to a 61% reduction in work capacity) for those infected with HIV/AIDS due to occupational risk.

Original Personal Declaration of Time and Area of Service in the Army with Regional Allowance according to form No. 04B-HBKV (issued together with Circular No. 181/2016/TT-BQP for those who served in the army before January 1, 2007, in areas with regional allowances, and whose social insurance book does not fully reflect the information for calculating the regional allowance).

For those participating in voluntary social insurance, including those who are serving a prison sentence, those who have illegally exited the country and returned to reside legally, and those who have been declared missing by a court and have returned

The application process for pension benefits for those participating in voluntary social insurance, serving a prison sentence, illegally exiting the country, etc., is as follows:

Original Social Insurance Booklet and original Application Form according to form No. 14-HSB.

Minutes of Assessment of Reduced Work Capacity by the Council for Assessment of Work Capacity Impairment (original, in case the employee already has minutes of assessment to enjoy other policies and meets the conditions, a certified copy can be used) for those who retire due to reduced work capacity.

Certified copy of the Certificate of HIV/AIDS Infection due to occupational risk (equivalent to a 61% reduction in work capacity) for those infected with HIV/AIDS due to occupational risk.

– In the case of serving a prison sentence from January 1, 2016, onwards, include the original Power of Attorney (form No. 13-HSB).

Those participating in voluntary social insurance or preserving their social insurance participation period must prepare the Application Form according to form No. 14-HSB

– If you have completed your prison sentence from January 1, 1995, to before January 1, 2016, include a certified copy of one of the following documents: Certified copy of the Certificate of Completion of Prison Sentence, or Pardon Decision for Early Release from Prison, or Decision on Exemption or Temporary Suspension of Execution of Prison Sentence.

– In the case of illegal exit from the country, include a certified copy of the document from the competent state agency on returning to reside legally in the country.

– In the case of a missing person returning, include a certified copy of the Decision of the Court with legal effect to cancel the declaration of missing.

For those with a decision or certificate of eligibility to receive a pension or monthly allowance under Decree 09/1998/ND-CP when they reach the required age

Those who have been certified as eligible for a pension or monthly allowance based on age or have a decision to that effect need to prepare the following documents:

Original Decision or Certificate of Eligibility to Receive a Pension when Reaching the Required Age or to Receive a Monthly Allowance according to Decree 09/1998/ND-CP (original); if these documents are lost, include Form No. 14-HSB stating the reason for the loss.

2. Procedure for Receiving Pension Benefits for Employees (Implementation Steps)

Step 1: Prepare the application file according to the above components.

Step 2: Submit the application file to the social insurance agency as follows:

Case of direct submission

– For employees who are paying social insurance: Up to the point when the employee is eligible to receive a pension, they must submit the application file within 30 days to the district-level social insurance agency where they are paying social insurance.

– Other cases: Submit to the district-level social insurance agency or provincial social insurance agency of their place of residence.

You can submit the application directly to the competent authority or send it by express delivery to the social insurance agency

Case of electronic transaction

Employees must register to receive a verification code and send the electronic application file to the Vietnam Social Insurance Portal or through an I-VAN organization. If the paper application file is not converted into an electronic format, send the paper file to the social insurance agency via express delivery service.

When it is time to receive the pension, within 30 days, the employee who is preserving the social insurance participation period or participating in voluntary social insurance shall submit the application file prescribed in Clause 2, Article 108 of this Law to the social insurance agency.

Step 3: Wait for the result (maximum of 12 working days from the date the social insurance agency receives the full application file according to the regulations, the result will be given to the person performing the procedure).

3. Some Points to Note

Employees are allowed to postpone retirement in the case of illness or force majeure, but the postponement period must not exceed 6 months.

For officials in public non-business units with professional qualifications, if they wish to and meet the criteria for extending their retirement age, the unit shall issue a decision to dismiss them from the management position and transfer them to the position of an employee, and extend the working time according to the regulations on employees before the retirement age.
