Compliance Launch
This type of launch is for businesses that manufacture or import food-related products such as processed foods, food additives, food contact materials, packaging materials, and food containers. If these products meet the technical and quality standards, they must be declared compliant before being released to the market.
Businesses that manufacture or import food-related products are required to register and declare their products.
Before releasing their products into the market, businesses must register their compliance with the relevant state agency.
Conformity Declaration
If the technical and quality standards are not met, a conformity declaration must be submitted to the relevant state agency before releasing the product to the market.
This type of launch is for businesses that manufacture or import packaged foods, food additives, food contact materials, packaging materials, and food containers that do not meet the technical and quality standards. In this case, a conformity declaration must be submitted to the relevant state agency before releasing the product to the market.
2 Steps and Procedures for a Product Launch
Step 1: Self-Declaration by the Business
The business or individual involved in the food industry will self-declare their product through mass media, their website, or at their headquarters.
Step 2: Submit the Self-Declaration to the Relevant State Agency
The business or individual will submit one set of documents for self-declaration to the relevant state agency designated by the Provincial People’s Committee. The set of documents includes the following:

– A test result of food safety and hygiene issued by a designated or recognized testing laboratory that meets ISO 17025 and other criteria issued by the Ministry of Health within 12 months from the date of submission.

– Scientific evidence proving the efficacy of the product or its ingredients.
Step 3: Review and Notification by the Relevant State Agency
The state management agency will receive, review, and archive the business’s documents. They will then notify the business and publish the business name and product name on their website.
4 Some Notes on the Self-Declaration Process
The language used in the documents must be Vietnamese. If the documents are in English, they must be translated into Vietnamese and notarized. The documents must be valid at the time of self-declaration.
If an organization or individual has two or more production facilities manufacturing the same product, they must submit their documents to the state management agency in the locality where they first registered their business.
The documents must be in Vietnamese. If they are in English, they must be translated and notarized.
In case an organization or individual has two or more production facilities manufacturing the same product, they can choose to submit their documents to only one state management agency in the locality where one of their production facilities is located. Subsequent self-declarations must be submitted to the same agency.
The business, organization, or individual is fully responsible for the safety and quality of the product they declare.
– If there are any changes to the product name, origin, or ingredients, the business, organization, or individual must notify and re-declare the product.
– Any other changes must be reported to the relevant state agency.
